– Memberships are paid in advance of service and are not subject to refund; provided that unused service credits will rollover to the next month if the member does not book any services during any particular month, but any such rolled over credits shall expire on the date that is 3 months from the date of such rollover. The first membership payment shall be paid on the date hereof and each subsequent monthly membership payment shall be paid on the thirty-day anniversary of the previous monthly membership payment.
– On the date hereof you shall pay a non-refundable one-time enrollment fee of $25. Membership dues are paid by monthly automatic electronic payment to the credit card or debit card set forth on the signature page to this Agreement below. Your monthly membership fee will be charged to your card each month. If your payment is declined, there will be an additional $25 fee.
– Memberships 30 days past due will be cancelled. Reinstatement requires payment of dues owed, reinstatement fee of $25 and payment of first month of new membership.
– The membership is for a minimum of three (3) months and cannot be cancelled within such initial three (3) month period. After the initial three (3) month period, your membership will be automatically renewed each month unless you give notice of cancellation at least two (2) weeks before your next monthly payment date. All memberships fees are collected via auto-debit (i.e., electronic funds transfer) from the debit card or credit card set forth next to your signature on the signature page of this agreement. By providing your debit card or credit card information you authorize Bare Necessities to automatically withdraw dues and fees as follows: the first membership payment shall be paid on the date hereof and each subsequent monthly membership payment shall be paid on the thirty-day anniversary of the previous monthly membership payment. If your payment is declined on your payment date, there will be an additional $25 fee. Memberships 30 days past due will be cancelled. – By Appointment only: Membership entitles Member to the services set forth in the Membership Options section on the summary page above; provided that Member must make advance reservations for any services in accordance with Bare Necessities’ current reservation policy (which is subject change at Bare Necessities’ discretion). If you book an appointment and do not show up, that will count as your membership service for that month. You can re-book the missed appointment for the 10% off of the regular price. All cancellations MUST BE made at least 24 hours in advance to avoid losing your membership service for that month. If you do not use your monthly membership service for any given month, your monthly credit will rollover to the next month; provided that any such rolled over credits shall expire on the date that is 3 months from the date of such rollover and Member shall not be entitled to any refund thereof.
– Limited Availability: Bare Necessities may close its facility for certifications, maintenance, selected holidays and other hours based on municipal requirements or requirements of Bare Necessities and no such closure shall affect Member’s obligation to pay monthly payments or entitle Member to any refunds of such.
– Freeze Policy – Members may put their membership on hold, in one month increments, for up to three (3) months per year for a fee of $25 per freeze request. Notice of freeze must be given to Bare Necessities via e-mail at membership@bnwax.com at least 5 business days prior to the your next monthly payment date to be frozen. Members will not be billed for membership during frozen months. Billing will resume automatically upon end of freeze. The current membership agreement will be extended by the number of months frozen.
– Release. EXCEPT AS OTHERWISE EXPRESSLY STATED BY US IN WRITING AT THE TIME OF PURCHASE OR OTHERWISE, IN NO EVENT ARE WE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY, WHETHER RESULTING, IN WHOLE OR IN PART, FROM BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING STRICT LIABILITY AND NEGLIGENCE) OR OTHERWISE, FOR ANY DAMAGES, INCLUDING SPECIAL, INCIDENTAL, EXEMPLARY, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT INCLUDE DAMAGES FOR ANY PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, INJURIES TO PROPERTY AND LOSS OF PROFIT, REVENUE OR BUSINESS, AS A DIRECT OR INDIRECT RESULT OF: (I) YOUR BREACH OR VIOLATION OF ANY TERM OR CONDITION OF OUR TERMS AND CONDITIONS; OR (II) YOUR ACCESS AND USE OF ANY BARE NECESSITIES SERVICE.
– Indemnification. Member hereby agrees to defend, indemnify and hold harmless Bare Necessities and its officers, directors, members, managers, shareholders, employees, independent contractors, agents and representatives from and against all claims and expenses, including reasonable attorneys’ fees, arising out of or attributable to: (i) your breach or violation of this agreement or any other of Bare Necessities’ terms and conditions (whether or not included in this agreement or set forth online); (ii) your failure to provide accurate, complete and current information requested or required by us; (iii) your impermissible or unauthorized access or use of any service provided by Bare Necessities; or (iv) any personal injury, property damage or emotional distress caused by Member.
– Severability – If any portion of this agreement is deemed illegal, void or unenforceable, then the remaining agreement shall remain in effect.
